Prohibition of Recreational Marihuana Establishments

AN ORDINANCE TO PROHIBIT RECREATIONAL MARIHUANA ESTABLISHMENTS IN THE
VILLAGE OF EAU CLAIRE PURSUANT TO THE MICHIGAN REGULATION
AND TAXATION OF MARIHUANA ACT.
THE VILLAGE OF EAU CLAIRE OF BERRIEN COUNTY ORDAINS:
SECTION 1: TITLE AND PURPOSE
(a) This ordinance shall be known as the Village of Eau Claire Recreational
Marihuana Establishment Opt Out Ordinance.
(b) The purpose of this Ordinance is to completely prohibit recreational Marihuana
Establishments within the Village of Eau Claire.
SECTION 2: PROHIBITION
As permitted in Section 6.1 of the Michigan Regulation and Taxation of Marihuana Act (the Act), recreational marihuana establishments as defined in the Act are prohibited from operating in the Village of Eau Claire.
SECTION 3: NOTICE TO BE PUBLISHED
The Village Clerk shall publish a notice of the adoption of this Ordinance in the manner required by law, stating that a copy of said Code is available at the office of the Village Clerk for inspection by the public during regular business hours.
SECTION 4: EFFECTIVE DATE
This Ordinance shall become effective immediately upon publication as provided by law.
SECTION 5: PUBLICATION OR POSTING
The Village Clerk shall certify to the adoption of this Ordinance and cause the same to be posted or published as required by law.
